As the numbers continue to look terrible for Democrats this November, there is a real possibility they will lose the Senate and maybe even the House. So, Justice Breyer, who’s been a sitting justice for 27 years since being appointed by President Bill Clinton, will be stepping down and retiring from the Supreme Court, reports The Daily Wire.
If Breyer were to hold onto his seat, the left may miss the opportunity to replace him with a liberal pick if they lose the Senate after midterms. However, as some are pointing out, it may not be an easy process confirming a new justice even as they control the Senate. Even though it only takes a simple majority to confirm a judge since the judicial filibuster was nuked, the Democrats have spent the last few months berating and slandering two of their own in an attempt to toss out the filibuster entirely and pass the federal election overhaul legislation.

Now, it might be extremely wishful thinking to believe Manchin and Sinema will actually hold up a judicial appointment as an act of retribution. They are still Democrats, and while they don’t much like the idea of tossing out the filibuster, they do have an interest in keeping an effectively liberal court leaning as it is.
(You can attempt to argue the court leans conservative, but I’ve yet to see much evidence of that, regardless of who appointed the justices.)
I’m don’t believe there will be much in their way as Democrats indubitably seek to seat a wild-eyed radical on the Supreme Court.
Maybe Biden will nominate Kamala Harris to get her out of the White House. It would be difficult to find a more radical or unlikable hag to receive a lifetime appointment. Would she have her crazy cackle dictated into her decisions?
