Last night President @RealDonaldTrump, the most followed and prolific Twitter, was unceremoniously banned from the platform because he disagreed with the political views of the founder & CEO of Twitter. Mark Zuckerberg followed suit and banned Trump from Facebook 'indefinitely'. Gab.com immediately reached out to the president with commitments to strengthen the capacity of the upstart social media platform, to handle more expected web traffic. By 11am today, Gab was completely overwhelmed and browsers could not load the pages. Unlike Twitter, and it's free speech alternative, Parler; Gab also has group forums and organizational pages. All these free speech alternatives have a ways to go, before they develop the full set of features, automations, and interactivity that the established platforms have. Rules Suspended, Stitt May Call Special Session
Just hours before today's scheduled court proceedings against Gov. Stitt & the ABLE Commission, A District Court in OKC rescheduled the proceedings to January 8th.
All Injunctions against enforcement are also extended. This pertains to the early closure orders for all dining and nightclubs, as well as taverns. The plaintiffs argue that state laws and constitutional order was grossly ignored by the state, and no authority to impose penalties is established. The ABLE Commission has declined so far, to defend the rationale of legal foundation for the citations they have issued to several struggling Oklahoma establishments. Another development which might be related, was the hint from Governor Stitt that a special session may be called as early as next week. It was a comment he made at a press conference about vaccine distributions at nursing homes. He said some legal remedy is needed to facilitate video conference meetings of state & municipal agencies. Governor Stitt could simply request another statutory Health Emergency and activate a special session within 48 hours. The move could lead to a 30-day granting of special powers for the governor, but the legislature would have oversight and could revoke the emergency any time within those 30 days. Plaintiff's attorney, Frank Urbanic, leveraged the same Health Emergency declaration last April, when he published an expose' on the tactics of the governor's office, utilizing what appears to be some type of unofficial martial law powers, based on a finding that Oklahoma was in a state of widespread riot and/or insurrection, last March. Within hours of SoonerPolitics and others republishing Urbanic's discoveries, the governor called the health emergency request of the legislature. |

Civil Rights Attorney, Frank Urbanic, is our 2020 Citizen of the year for his efforts to hold state and local govt to respect and defend the federal & state Constitutions in their official duties.
In a year like none other, 2020 is a memory we are all destined to never forget(sadly). But in times of trial, peril, and tyranny, those who remind us of our civilization's founding principles are especially to be valued. Those who rise up to champion the cause of individual liberty, societal virtue, and advancement of prosperity; they are to be esteemed. When we knew so little about a global virus from a Chinese laboratory, our nation had to revisit our founding principles and put them to the test. When Governor Stitt first ordered a ban on large gatherings of people, Frank Urbanic researched official state documents and discovered some very troubling data. Urbanic published a blog post on his law firm's website, indicating that the governor seemed to have essentially declared that a state of widespread riot is endangering the state. At least that is the implication of the Attorney general's legal notices. SoonerPolitics reposted the article on Thursday, April 2nd, and within hours the governor changed course and properly invoked a "Health Emergency Act" declaration, & submitting a request of the legislature to grant him 30 days of special powers with legislative oversight. As those 30 days came to an end, the governor was celebrated nationally as an example of how a state gets back up on it's feet and thriving. |
During a press conference at a vaccine location, Gov. Kevin Stitt took one question regarding a special session to resolve meetings, voting, & public policy matters. He said he's been open to the idea of a special session 'if the pro temp and speaker want one'.
He did not specifically say that the special session would be precipitated by a Health Emergency Declaration, like the action he took in early April. That statutory clause allows the proper implementation of emergency orders with a 30-day sunset and a legislative oversight committee. Recently, the governor appears to be making new laws on his own, by declaring either a state of civil unrest (riot & insurrection) or a natural or manmade disaster emergency. Neither of those last two categories are in any way applicable to the spread of a new virus strain, but the governor seems to prefer them as they allow him an open-ended sort of martial law powers. No previous governor has exercised so much emergency powers since Alfalfa Bill Murray declared martial law some 30 times in his tumultuous one term as governor in the early 1930s. Murray even led soldiers to war against Texas in a dispute over a border bridge near Durant. |
The fiery floor debater of the Oklahoma House of representatives, John Bennett; is declaring his candidacy to lead the Oklahoma Republican Party in 2021. Bennett has spent much of the past 30 years in national security and anti-terrorist efforts in military service. He has also spent years training civil law enforcement. As the first Republican ever elected in the 2nd House district (Sallisaw area), Bennett has been a unifying voice for common sense and bipartisan solutions which working Democrats and Republicans largely support. Bennett helped change Eastern and Southern Oklahoma into a solidly 'red' electoral region. Bennett was among the first elected officials in Oklahoma to support the Trump candidacy for president. He's a husband and father & community leader. Lawmakers of the past 10 years remember Bennett's back row fiery speeches advocating for fiscal responsibility and agency accountability, as well as parental rights and education reform. Despite Bennet's advancement in House leadership, he always preferred the back row. Peace officers and other professionals in criminal justice have credited Bennett for bringing fundamental reforms and relief to our system of law enforcement and court adjudication. The Supreme Court's McGirt ruling of 2020 set up an unconstitutional 2-tier justice system in Eastern Oklahoma. Our state legislature seems completely oblivious to the coming rage over the 'diplomatic immunity' that multiple thousands of our neighbors now claim. Some are hoping that the tribal courts will create commensurate laws so that every subject of this police state get the same harsh treatment. Many others are calling for Oklahoma to adjust our criminal code to reflect the federal statutes. For many crimes, especially white collar crimes; the stark contrast is an outrage to the 14th Amendment right of equal protections. Not one filed bill in the 2021 legislature addresses this inequity and denial of our 14th amendment rights of equal protection under the law. |
Frank Urbanic, an Oklahoma Civil Rights Attorney; just restored the rights of 6 Oklahoma taverns and restaurants, to remain fully open to the statutory 2am business hours. A district court judge deemed that an injunction against governor Stitt and the ABLE Commission(the state agency enforcing statutory law and agency rules) were causing irreparable harm to several plaintiffs without first providing due process. Urbanic told Sooner Politics last week, that ABLE was beginning a practice of revoking liquor licenses if a tavern did not shut their doors at 11pm, daily. The problem with that is, The governor and state agencies were not establishing proper rulemaking procedures. The Judge's act applies only to the 6 plaintiff restaurants & taverns, because they were the only ones who fought back. This ought to encourage more restaurants to defend their rights and claim their liberties; and hold the govt. to accountability. What are proper agency rules? When an agency deems new rules are essential, they are required to publish such proposed rules and allow for a public comment period, to gauge the impact on the people. |
